Who was Shah Bano?
Shah Bano resided in Indore, Madhya Pradesh. In 1978, at the age of 62, her husband Mohammad Ahmed divorced her and kicked her out of the house. Shah Bano had 5 children. The issue of getting alimony from her husband came before the Supreme Court in 1981. The husband said he was not obliged to pay alimony to Shah Bano. The Supreme Court gave its verdict on Section 125 of the CrPC in 1985. This section relates to the determination of maintenance in case of divorce. The Supreme Court upheld the decision of the Madhya Pradesh High Court to award maintenance to Shah Bano.
The Rajiv Gandhi government had reversed the decision
The Muslim Personal Law Board has launched a nationwide movement against the court’s ruling in favor of Shah Bano. All Muslim organizations in the country said the court was violating their rights by interfering in their family and religious affairs.
Facing opposition from the country, the then Rajiv Gandhi government passed a law in 1986. This law was called the Protection of Rights of Muslim Women Act, 1986. This diluted the Supreme Court’s decision. Under the law, women were only allowed to claim maintenance during Iddat (period of separation). Arif Mohammad Khan, then Minister of State for Interior, had resigned against this decision of the Rajiv Gandhi government.
Triple talaq law passed in 2019
At that time, the BJP had said: “If we come to power, we will bring changes in personal laws. In 2017, the Supreme Court declared triple talaq unconstitutional and asked the government to legislate on it. The Modi government, with an absolute majority, saw this as the ideal opportunity to carry out its decades-old agenda. On July 30, 2019, Modi passed a law against triple talaq.
