The police had arrested the accused Akshay Shinde, 24, on August 17. He was killed during a clash on September 23. He was accused of sexually exploiting two girls.
Police have arrested school president Uday Kotwal and secretary Tushar Apte in the sexual exploitation case of two girls in Badlapur in Thane district of Maharashtra. On October 1, the Bombay High Court had rejected the anticipatory bail of Kotwal and Apte. Thane Crime Branch will hand over both of them to the SIT, which is investigating the entire case.
On August 12 and 13, in Badlapur, two girls aged 3 and 4 attending kindergarten were sexually assaulted by a sweeper in the girls’ toilets of the school. The main accused, Akshay Shinde, was arrested by the police on August 17. He died during a clash with police on September 23.
The encounter case of the main accused will be heard today in the Bombay High Court. During the last hearing on September 25, the court raised many questions regarding this meeting. The court had asked the Maharashtra government: How can we accept that 4 officers cannot handle an accused. Handcuffs were also attached. If there was a self-defense situation, the accused was shot in the leg and not in the head.
The court said: “If the officer who fired the shot is a deputy police inspector, then he cannot say that he did not know how to react. He must know where to shoot.
High Court Questions in Latest Hearing, State Government’s Response… Court: Was the officer who took away Akshay Shinde from the Thane crime branch the police?
state government: Yes.
Court: Was the place where the incident happened vacant or were there settlements and houses nearby?
state government: There were hills on the right and a small town on the left. As soon as the incident happened, Akshay and the injured policeman were rushed to the hospital.
Court: Which hospital did you take, how far away was it?
state government: Shivaji Hospital near Kalwa. The journey took around 25 minutes. It was the closest hospital.
Court: How could there be negligence when someone accused of such a serious crime was being arrested. What is the SOP, was he handcuffed?
state government: She was busy, she had asked for water.
Court: Did you take the prints from the gun?
state government: FSL had taken fingerprints.
Court: You say that the accused fired 3 bullets, that the police officer was hit by a bullet, where did the other 2 go? Usually, in self-defense, do we shoot the leg or the hand?
state government: The officer paid no attention and reacted neutrally.
Court: How can anyone believe that there were 4 police officers in the vehicle and they couldn’t handle one of the accused?
state government: It was an immediate reaction.
Said- The wife of the accused calls him a beast Maharashtra Chief Minister Eknath Shinde said police opened fire on Akshay Shinde in self-defense. Shinde said if he had run away, the opposition would have asked if the police had any showpieces and not weapons. Ask why we let him escape?
Shinde was speaking at the India Today conclave. He said a police officer was injured in the clash and we should support the police. Akshay Shinde had 4 wives, one of them ran away and filed a police complaint. She accused Akshay of unnatural sex and said he was a demon.
The Maharashtra Chief Minister said the girls raped in Badlapur were of the age of the accused’s daughters. Imagine what they had to go through. It was an unfortunate incident.
However, on October 1, the Maharashtra government constituted a committee to probe the Akshay Shinde encounter case. A single-member commission will conduct the probe under Allahabad High Court Chief Justice (retd) Dilip Bhosale.
Badlapur sexual exploitation case, understand in 3 points…
August 12-13: The accused entered the school on August 1, sexually assaulted after 12 days Akshay Shinde, accused of raping girls, worked as a sweeper at the school. He was not appointed under contract until August 1. On August 12 and 13, he sexually assaulted two girls aged 3 and 4, kindergarten students, in the girls’ bathroom at the school.
After the incident, both girls were afraid to go to school. When a girl’s parents became suspicious, they would question their daughter. After that, the girl told the whole story. Then that girl’s parents talked to the other girl’s parents. After that, a medical examination was carried out on both girls, during which sexual abuse was revealed.
August 17: Police arrested the accused, the girls called Akshay as Dada. Police interrogation revealed that the girl called the accused Shinde as Dada (Marathi word for elder brother). According to the girl, “Dada” opened her clothes and touched her inappropriately. There were no female employees at the school where the incident took place.
When the families of the two girls reached the police station to register the case, the police also delayed in registering the FIR. The victims’ families asked for help from social workers. Two days later, on August 16, late at night, the police filed a complaint. The police had arrested the accused on August 17.
August 20: People stopped trains, threw stones at police and vandalized schools.
On August 20, protesters opened the main gate of the school, entered and vandalized it.
The crowd had protested at Badlapur railway station from 8 am to 6 pm on August 20 over the incident. The movement of local trains remained interrupted for more than 10 hours. In the evening, the police left the railway track with lathi blows. Then the crowd also threw stones at the police.
Minister Girish Mahajan went to Badlapur railway station to speak to the protesters, but had to return. After this, Deputy Chief Minister Devendra Fadnavis announced the establishment of SIT. Additionally, the government had said the case would be tried in a fast-track court.
The state government has suspended three police officers, including the police inspector of Badlapur police station, for delay in registering the case. Additionally, some school staff, including the principal, were also suspended.
The inspector who shot the accused had caught Dawood’s brother. Inspector Sanjay Shinde, who shot Akshay, accused of raping girls at Badlapur school, was the head of the anti-extortion cell of the Thane Crime Branch. He was also part of dating specialist Pradeep Sharma’s team. The same team had arrested Iqbal Kaskar, brother of underworld don Dawood, in 2017.
On March 19, the Bombay High Court sentenced dating expert Pradeep Sharma to life in prison. He was convicted in the 2006 fake encounter case of a close associate of gangster Chhota Rajan. A documentary series was also made on the story of the meeting of Pradeep Sharma’s team.
An investigation was also conducted against Sanjay Shinde in 2012. In 2012, Vijay Palande, an accused in two murder cases, had escaped from police custody. Sanjay’s uniform was found in the SUV he fled in. He was also the subject of controversy in 2000 in the kidnapping case.
