We thought that if the CBI investigates, our daughter will get justice, but after the accused was released on bail, it seems the system is trying to defeat us.
The mother of a trainee doctor who was a victim of rape and murder in Kolkata had said this on December 13 after the two accused were released on bail. More than 4 months have passed since the incident at RG Kar Medical College and Hospital on August 9. Meanwhile, two renowned lawyers in the country have dropped the victim’s case.
On December 12, no one represented the victim in the trial court. The following day, two of the three accused were released on bail. Disappointed with the CBI probe, the victim’s family approached the High Court on December 19 and demanded a fresh probe.
The question now is why the request for an investigation suddenly appeared in the first place? What happened from August 9 until December? How was the accused released on bail? Now, who will defend the cause of the victim’s family? Indianewsget investigated this question. this report-
Trainee doctor’s mother says: ‘Police didn’t arrest killers’ The victim’s mother said, “My daughter’s killers could have been arrested on the first day, but the Kolkata Police didn’t even try. When the CBI arrested former superintendent Sandeep Ghosh and former Tala police station in-charge Abhijit Mandal a month after the incident, we thought justice would be served, but no.
“CBI was to file a chargesheet against him in court by December 13, but that did not happen. Due to this, both the accused were released on bail. We are not at all satisfied with the CBI investigation If the CBI is investigating properly, why was the charge sheet not filed within 90 days of the arrest?
The victim’s father said: The accused are very powerful, they can even take our lives. The father of the trainee doctor said: “The accused are very powerful. We are ordinary people. We can only fight for justice through legal means. The High Court assured us on December 19 that it would follow the case itself if necessary.
Are you afraid? To this question, the father of the trainee doctor replied: “Fear! Fear of what? They can take our lives. What more can we do? We are not afraid of death. We will seek justice at all costs. Whatever happens, we will not lose courage.
Who are the two lawyers who abandoned the case, what was the reason for their withdrawal?
The victim’s family had initially appointed a senior lawyer, Bikash Ranjan Bhattacharya. Bhattacharya and his team represented him before the Supreme Court, the High Court and the Sealdah Court. Bhattacharya had played a key role in demanding a CBI probe into the matter.
The trainee doctor’s father said, “We wanted Bhattacharya to argue our case in the High Court and the Sealdah court. We were looking for another lawyer for the Supreme Court. Bhattacharya did not like this and filed our case in all courts.
According to sources, due to Bhattacharya’s busy schedule, the victim’s family had to find a new lawyer. According to Supreme Court records, Bhattacharya had represented the victim’s family on August 20, August 22 and September 9 last year.
Since September, lawyer Vrinda Grover and her team have represented the victim’s family in all courts. On December 11, Vrinda Grover and her team distanced themselves from the matter and released a statement saying:
Due to obstructive circumstances, Vrinda Grover is forced to withdraw from this case. From now on, she will no longer represent the victim’s family. The Grover Chamber provided free legal services and represented the victim’s family in all courts beginning in September 2024.
Why did Vrinda Grover refuse to take up this cause?
The victim’s father said: “On December 11, Vrinda Grover messaged me and said she would not take up our cause. Other than that, he didn’t say anything. A hearing was held in the Magistrate’s Court on December 12. There was no lawyer to present our case that day.
“The next day, the former director and former head of the police station was released on bail. What Vrinda Grover did to us was completely dishonest. We will certainly respond to this deception when the time comes.
Bhattacharya said: Accused are close to people in power Bikash Ranjan Bhattacharya refused to comment on the appointment of Vrinda Grover in his place and then his sudden withdrawal from the case. Regarding the possibility of the accused influencing the case, he said: “
The accused are very close to power. So if the case is concerned, it won’t really be a surprise. However, no matter how dire the circumstances, there is nothing we can do but rely on the law.
Now, who will defend the cause of the victim’s family? After Vrinda Grover left the case, the victim’s family appealed to doctors for help. The West Bengal Joint Doctors Platform (WBJPD) got him talking to several lawyers.
After this, the victim’s family roped in senior lawyer Karuna Nandi to present their case. Karuna is already representing doctors in the Supreme Court in the RG Kar rape and murder case.
Senior member of WBJPD, Dr. Kaushik Chaki said, “Advocate Karuna had spoken to the family of the trainee doctor through video call. She then agreed to defend her case. His chamber lawyer Sudipta Maitra will represent the victim in the High Court. Advocate Rajdeep Haldhar, advocate Amartya Dey and advocate Khuddi Ojha will defend the victim’s case in the Sealdah court.
“Even after 4 months, the victim’s mother’s statement was not taken into account” Dr Kaushik Chaki claimed that the CBI was yet to take the testimony of the trainee doctor’s mother. According to Dr. Chaki, “the witness list contained the names of 123 people. Since November 4, 50 people have testified in court. These included the victim’s father and CBI officer Seema Pahuja.
“However, the CBI did not take the testimony of the trainee doctor’s mother for 4 months. The High Court was informed of this on December 19. Justice Tirthankar Ghosh ordered the CBI to submit the status report on December 24.
According to media reports, the CBI has also taken statements from four doctors with whom the victim had dinner in the seminar hall on the night of August 9. Apart from these, seven doctors from the Delhi forensic team, three doctors from the Kolkata forensic team and one doctor from the Chandigarh forensic team were also questioned.
Sanjay’s polygraph test was conducted by the forensic team on August 25 in the Presidential Jail in Kolkata.
CBI had submitted the status report before the Supreme Court on December 10. The agency had said that the hearing was being held daily from Monday to Thursday at the Sealdah Magistrate’s Court. Out of 81 prosecution witnesses, 43 people were questioned. The hearing in the rape and murder case is expected to conclude in the trial court within a month.

The judge questioned him for 6 hours under article 313. During this, more than 100 questions were asked. Before the trial court, Sanjay Roy reiterated that he was involved.
On November 11, Sanjay had shouted from inside the van and declared himself innocent.
Earlier on November 11, while being brought back after appearing before the Sealdah court, he had shouted from the police van: “I am telling you that it was Vineet Goyal who plotted the whole incident and involved.
Sanjay had first accused the Mamata government on November 4. When police took him away after his appearance in Sealdah court, he was seen for the first time saying on camera that Mamata’s government was implicating him. He was threatened not to open his mouth.
CBI had said: trainee doctor was not a victim of gang rape The body of a serving junior doctor was found on August 9 in the seminar hall of RG Kar Medical College and Hospital. The police had arrested Sanjay Roy for rape and murder. He worked as a civic volunteer with the Calcutta Police.
CBI filed a chargesheet in the High Court on October 7, in which Sanjay was named as the sole accused in rape and murder. The agency said the trainee doctor was not a victim of gang rape.
Dr Chaki said the rape and murder case will come up before the High Court on December 23. The hearing is scheduled at the Magistrate’s Court on January 2 and at the Supreme Court on March 17. If there is no major development related to the case in favor of the victim before March 17, lawyer Karuna Nandi can then approach the Supreme Court.

It is alleged that the suicide theory was put forward by the then principal of the medical college, Dr Sandeep Ghosh.
